It's a state case, so the DOJ can't do anything with it.
Some of the counts were committed before he gained the position of king can do no wrong. The ones that were committed while he was sitting on the throne would assuredly test whether there is anything a king can do that is not official duty (Roberts, J., "It is clear from the history of the Constitution that the framers would have considered reimbursement of hush money payments to be well within the ambit of the duties of the office, even if not precisely within the core duties" .
In the normal world, a dismissal N.O.V. happens when there is clearly a lack of evidence to support the jury's verdict. That's a pretty hard sell on this one.
As far as I can see, the only reason you might believe he has a decent chance of dismissal is because his lawyers say so, and even filed a motion saying that!
Obviously, in these troubled times, any prediction is subject to the looniest outcome. Even so, Merchan has not thus far taken kindly to the Trump team's shenanigans.
What's more, the Supremes just denied a whine from the Trump gang asking that he be allowed to badmouth everyone involved in the case. So they're not down with the idea that Merchan has fucked it all up.

Sentencing delayed if still appropriate after considering the motion to dismiss.

I've spent a fair bit of time searching, and I can't find where Justice Merchan said that, or even where he said "..."
I believe Merchan said that he was open to examining whether the Supremes gave Trump an unlimited Get Out of Jail Free card.
And for sure, Trump's incoming WH counsel has said that.
But there remain two things:
1. What part of the hush money case is covered by the Supreme's immunity decision? and
2. If some of the evidence was inadmissible, was its admission harmless error?
I'm happy to read what Merchan said earlier...
Just be so kind as to give me a link.

"Lastly, this court concludes that if error occurred regarding the introduction of the challenged evidence, such error was harmless in light of the overwhelming evidence of guilt." Slip opinion, at 41.
But Merchan's kind of a jokester, I guess. Lambaste the guy in one ruling and then, THIS TIME FOR SURE, do the right thing and dismiss the case.

Our folks used to at least pay lip service to our concerns, since at least the BLM movement forward they've just given up. And I'm sure part of the reason now is that the repub party has been sold to a revolting billionaire who isn't afraid to spend millions of dollars to defeat anyone who crosses him.

I would love to get my hands on his medical records. I know I could get to the crux of the matter quickly. Years of training and experience. My boss used to call me "a finely tuned instrument" because of my diagnostic skills with our neuro patients.
They are all mostly DINOs to me now. Until proven otherwise. I consider this last election as a giant reset and until folks start proving what they will and won't stand and fight for they're all suss. But then I'm a victim of the Tim Moore mistress Trish Coleman defection.
