Why?

Because otherwise the next step is discovery. Quite a bit of private correspondence between ABC execs and also possibly Disney execs could go public. At best, it gives Trump more fodder for his attack on the media. Worst case, it gives Trump materials to try and do real financial harm to Disney / ABC. The district court where the case was filed has five Trump appointed judges.

There is a real risk - especially with it potentially being a jury trail in a red state - is a huge judgement in the line of the $700 million Fox had to pay over Tucker Carlson's slander of Dominion Voting Systems. Disney is struggling already and is being cautious with risk and spending. They settled a significant lawsuit against them by their film financier earlier this year.
