Article III, Section 3, Clause 1
Trump attacked Iran about a week ago without congressional approval and without provocation or eminent threat. It is known that Putin is aiding Iran with intelligence, giving Iran coordinates to target US military assets. Yesterday Trump spent an hour on the phone with Putin, and then announced that he was granting India an exception to US sanctions on Russian oil, allowing India to buy Russian crude just as the price of oil was spiking globally. It could be argued that the very reason Trump initiated this war was to benefit Putin and Netanyahu (a whole essay in itself). In addition, US intelligence knows that Russia has been targeting our diplomatic corps since 2016 with a directed energy weapon, as reported by 60 Minutes in their piece on Havana Syndrome.
Krasnov is openly committing treason, giving aid and comfort to our enemies. This on top of pitching an insurrection and attacking our Capitol, flouting our Constitution, and systematically destroying our government, our relations with our allies, and our global trade relations. It is way past time to haul this sack of chicken shit and bone spurs into court to face charges of CAPITAL TREASON. Normally I am opposed to capital punishment, but I hear that empathy is destroying western civilization, and in this particular instance I agree and therefore I am willing to make an exception for Trump and Hegseth.
I of course realize that this cannot happen until we pry these treasonous bastards out of office, but it is time to start naming the crime for what it is. It is a truism that you have to face and acknowledge a problem before you can defeat it. And the problem we are facing, the elephant in the room if you will, is treason.

(22,901 posts)Enemies are those nations the US has officially declared war on.
So, in order to be charged/convicted of treason for aiding and abetting enemies, war must be declared.
On the other hand, impeachment has no such legal restrictions- Trump could be impeached and removed for anything and everything he has done in his second term.
All it would take is enough representatives and senators with the courage to pursue it.
Courage
aye, theres the rub.

(3,473 posts)and goes to war without congressional authorization. Its an absurd technicality. Trump and others in this regime have called it a war, and anyone can see it for what it is. Many are calling it the start of WWIII. Regardless, Trump and the Republicans have effectively abrogated the constitution. If statutory or constitutional law is rendered meaningless, then a society falls back on natural law and universal jurisdiction.

Treason is defined as waging war on the United States, or aiding and abetting enemies during wartime.
Violating the constitution is not treason, but it should be grounds for impeachment.

(3,473 posts)providing intelligence to the Iranian government on targeting our military assets in this war, including our soldiers. Thats treason.
What Im saying may sound radical, but I dont think it is. The Trump regime are the radicals. As far as I can see they arent even really fascists, they are nihilistic psychopaths who are waging a civil war against the republic and pretending its just politics as usual. Theyre not trying to build anything, except maybe a few monuments to Trumps obscene ego. Their only agenda is cruelty, death and destruction. When people like this lie their way into power it is not on decent people to insist on etiquette and niceties and the fine points of the law. Thats how democracy surrenders to totalitarianism. Rather it behooves us to fight for ourselves and our fellow humanity and to stop it in its tracks. If this is allowed to go on it will lead to nuclear war if not in Iran then in the next war or the one after that.
And yes, the MAGA minions on the Supreme Court will try to stop it. When they do we will need to arrest them for aiding and abetting treason. Im not joking.

"The term 'enemies,' as used in the second clause, according to its settled meaning, at the time the Constitution was adopted, applies only to the subjects of a foreign power in a state of open hostility with us. It does not embrace rebels in insurrection against their own
government." US v. Greathouse

There no applicable cases to cite because, AFAIK (as far as the internet knows), there has never been a case where a defendant was charged with treason for aiding and abetting a nation the US had NOT declared war on.
The closest recent case would be that of the John Walker Lindh, the American Taliban dude, who went to fight for Afghanistan, and was captured.

The Rosenbergs were convicted of espionage, not treason.
Jane Fonda was never charged with treason.
And Trump, so far, has not committed the crime of treason.

(6,370 posts)The best legal definition we have of "enemy" in the clause is the one I provided, from US v. Greathouse, which states nothing about a war that has been declared by Congress.
Fiendish Thingy
(22,901 posts)No person has ever been indicted, let alone convicted, of treason, for aiding and abetting a nation the US hasnt declared war on.
So no case citations, because have never been any, but plenty of legal scholars/organizations believe that to be the criteria.

Putin is providing intelligence to the Iranians to help them target our military assets. This makes Putin an Iranian ally in this war. Trump is giving aid and comfort to Putin. We can insist on the finer points of the law like Merrick Garland coiffing his hair as we stroll merrily along into nuclear war, or we can acknowledge whats happening. Quibbling over the law in an existential crisis is how democracy surrenders to fascism.

If Russian crooks are peddling these things, you can bet a lot of them are now out there.
It doesn't seem that they've refined it enough to be able to aim it precisely. I'm sure there are some sickos in our own MIC who will accomplish that part.
(I always knew the syndrome was real, the State Dept types I've met would rather extract all their own teeth than admit to any human frailty)

(11,162 posts)Reported by Russia that they talked about the status of Israeli and US military actions. The White House had no intention of telling the American people this took place. Imagine Biden, or god forbid, Obama doing this.
