Motion allows George Floyd's heart tissue to be examined in Derek Chauvin's latest challenge to federal conviction

Source: WCCO (CBS affiliate, Twin Cities)

A judge ruled on Monday that lawyers for former Minneapolis police officer Derek Chauvin can get tests done on preserved samples of George Floyd's heart in the latest challenge to his 2022 federal conviction.

In November last year, Chauvin's attorney filed a motion to vacate the federal charges related to the May 2020 death of Floyd. Chauvin said he wouldn't have pleaded guilty had he known about the theories of Kansas pathologist Dr. William Schaetzel, who does not believe Chauvin's actions caused Floyd's death.

Schaetzel suggests Floyd died due to a high level of catecholamines -- a neurohormone important in stress response, associated with the flight-or-fight response -- or Takotsubo myocarditis, a heart condition that develops in response to an intense emotional or physical experience.

The motion also accuses Chauvin's attorney at the time, Eric Nelson, of ineffective counsel by failing to inform his client of Schaetzel's theory and failing to test samples of Floyd's heart despite the doctor's recommendations.

Yes, this is the infamous case where the white cop (Chauvin) with the help of 3 others, used his knee to pin Floyd's neck to the ground for 9 1/2 minutes. Chauvin is serving a 22 1/2 year sentence

This seems absurb beyond belief - we all saw the video of the 9 1/2 minutes where Floyd slowly expired despite Floyd's repeated "I can't breathe", and warnings from fellow cops and the EMT. Like gee, that a heart condition got him first, otherwise he would have lived 11 minutes or whatever. And Chauvin didn't pin his neck down for 11 minutes, so he didn't kill him, or something.

Does RFK Jr. agree with Schaetzel? Will president-elect fuckface pardon Chauvin? Nothing would surprise me anymore.

The official autopsy report from the Hennepin County Medical Examiner's Office determined Floyd's death was a homicide caused primarily by compression on his neck.

Meyers, in support of his motion, said Schaetzel contacted Nelson about this theory before Chauvin's federal conviction but Nelson never notified his client.

"... Nelson provided ineffective assistance of counsel to Mr. Chauvin by failing to consult with him on this issue," Judge Paul Magnuson wrote in his order.

Is Chauvin being coddled by racist sympathizers guards/administrators in prison? I can't help but wonder.

Chauvin’s agreement with prosecutors provides few avenues to reverse his plea. Bradford Colbert, a professor at Mitchell-Hamline School of Law, said in an interview with MPR News that Chauvin must convince a court that his lawyer was ineffective.
“That sounds easier than it is. Usually it’s very difficult to overcome your guilty plea on those grounds,” Colbert said.

In September 2023, a federal appellate court rejected Chauvin’s appeal. In a later petition with the district court to request a new trial, Chauvin argued that Nelson “did not even notify defendant of Schaetzel’s existence or allow defendant to make an informed decision on whether to call Schaetzel as a defense witness or to plead guilty in this case.”

In an August court filing, attorneys with the Justice Department’s Civil Rights Division argue that Nelson made a “strategic choice” not to explore Schaetzel’s “untested opinion.”

Federal prosecutors also contend that because Nelson consulted experts about Floyd’s medical issues at the state trial, Nelson did nothing wrong by not telling Chauvin about Schaetzel's email, which “provided additional support for a theory already rejected by a state jury.”

So the Schaetzel thing is an old row that has already been hoe'd. Or an old furrow that has already been plowed.

It seems he's getting a lot more deference than, say, if Floyd had strangled him to death.

Right, how is that different from being choked? Either way he died because you had your fucking knee on his neck for nine minutes, I'm pretty sure that would be: "an intense emotional or physical experience". Give it up your guilty!

take their last breath and that was George Floyd, calling out to his deceased mama.
I will never get that video recording out of my head. That cop was convicted because everyone that saw that tape, saw he murdered Floyd. I read that they were bouncers at a club in MN so they knew each other. That cop was convicted because he killed that poor man. I don't care about Floyd's heart and (why are they keeping it?). He died because he was suffocated by that cop who didn't like him and didn't want to deal with him anymore. The other two officers were jailed for not stopping him.

I hope that cop rots in prison for the rest of his life. I have no respect for cops that dismiss my thoughts either.
