Justice Amy Coney Barrett plays 'highly useful' role in Trump being denied immunity in hush-money case

The judge presiding over Donald Trump’s criminal hush-money case in New York on Monday refused to dismiss the dozens of felony convictions against the president-elect in light of the Supreme Court’s sweeping immunity decision, using, in part, the reasoning put forth by the last justice Trump himself placed on the high court.

The ruling stems from Trump’s May 2024 conviction on 34 counts of falsifying business records in the Empire State.

The charges resulted from a $130,000 hush-money payment made by Trump’s former personal attorney and fixer, Michael Cohen, to adult content creator Stormy Daniels in October 2016.

Acting New York Supreme Court Justice Juan Merchan cited Justice Amy Coney-Barrett’s concurring opinion in Trump v. United States to emphatically rule that the underlying conduct resulting in Trump’s convictions did not constitute the “official conduct” of a president that is entitled to absolute immunity from prosecution.

I actually have some hope for her not to rubber stamp every case the rwnj's bring to SCOTUS, unlike her colleagues Alito, Thomas and usually Gorsuch and Kavanaugh.

I don’t know if there are SC rulings in this but “high crimes and misdemeanors” would include State crimes I’d think. He, no one, will be convicted by the Senate but the midterms are very likely to be bad for them. Given his track record, these 3rd string JV nominations aren’t going to last and then he’s going into the stands to find bodies which won’t be a good look.

Just because one aspect of her concurring opinion in one of the worst decisions in modern history can be used as a silver lining doesn't mean she isn't part of a massive hurricane with tornado level cloud hanging over this country.

Am I missing something here? There should be no question about official conduct or immunity since he was not even president when the payment to Daniels was made.
