Colo. AG: Sheriffs lack standing to sue state over gun laws
The 55 Colorado sheriffs who filed a lawsuit against the state over two new gun-control laws dont have standing to sue, Colorado Attorney General John Suthers said.
Suthers, whose office is defending the state against the suit, said hes filed a motion in federal court saying sheriffs have never sued to defend other citizens rights, so they cannot now claim standing on this issue.
(snip)
But in Suthers motion to dismiss the sheriffs as plaintiffs, he says they have no standing on several grounds, not the least of which is long-standing legal precedent that bars political subdivisions of a state, such as counties, to sue that same state.
Suthers said sheriffs clearly are county officers, and their powers stem from the Colorado Constitution and the Colorado Legislature, which passed the new gun laws.

(39,665 posts)The AG is an insane right-winger with a record of trying to disenfranchise voters, and with eyes on the Governor's mansion he's been blatantly enabling the gun-lobby-backed recall taking place.
To have to do this is a smackdown on him, as well.
