Sounds like you have reason to be upset and that they're the ones who caused it. It also sounds like they're willing to pay to compensate you for that upset, but only if it actually settles the matter.

But I don't think that TCPA even applies. So they aren't worried about losing the lawsuit. They're worried about the bad publicity from your dissatisfaction. If they're going to get that either way... they might as well fight you in court.

You can probably get an attorney to give you a free consult just to see whether they think you have a case.
