Gilbert said Ramapo police “gave back a weapon to which he had no right. He didn’t have a license.”

Paul Piperato, Rockland County Clerk, confirmed that Groesbeck did not have a pistol license registered with either the state or county.

The town and police department had not yet filed their response in court to the lawsuit. But Stern, the lawyer representing Ramapo, said the the town will argue Groesbeck qualified to have a gun under a federal law that entitles former law enforcement officers to possess their service weapons, and exempts them from registering for a pistol permit.

Ramsey Police Chief Bryan Gurney said Groesbeck retired from the Ramsey police department around 1983. He said it wasn’t clear under what terms Groesbeck left the force.
